Sen. Shumer - We are going to war over Supreme Court! - UPDATED

According to Drudge, Senator Charle Shumer was overheard during a long cellphone conversation saying the following:
"Even William Rehnquist is more moderate than they expected. The only ones that resulted how they predicted were [Antonin] Scalia and [Ruth Bader] Ginsburg. So most of the time they've gotten their picks wrong, and that's what we want to do to them again."

"A Priscilla Owen or Janice Rogers Brown style appointment may not have been extraordinary to the appellate court but may be extraordinary to the Supreme Court."

"We are contemplating how we are going to go to war over this."
I don't think that to tone down the rhetoric is a viable option at this point.

UPDATE: Former Senator Fred Thompson has been named by President Bush to shepherd his eventual nominee through the confirmation process. This would throw Senator Cornyn back into the mix, as it had been assumed that the actions of Cornyn and his staff were due to this being his assignment.
