John Kerry nuanced on NSA

On ABC's This Week, John Kerry claims that he believes the NSA surveillence of domestic terror suspects to be illegal, but when asked by George Stephanopoulos, "If you think this is a clear violation of the law, why not move to cut off funding for the program?", Kerry responded,
"That's premature."
The ABC site does not yet have the transcript up so I can't review his comments in any context. But why, if one truly believes that President Bush's warrantless wiretaps are "a clear violation of the law," does one not take strong action to stop them immediately? Nuance, I suppose.
